The Uniform Services Former Spouses' Protection Act (USFPA) is an illegal act that unfairly allows up to 50% of a retired veterans military pension to be garnished and award it to servicemembers ex-spouse, even if the ex-spouse remarries. The act considers the retirement pay that the veteran earned after 20 years of faithful service, often at the risk of his or her life, to be considered community property and directs the court to divide it as such. This puts undue hardship on many of our veterans, who often find themselves burdened with arrears to make up and maintain payments, with no consideration made for disability, child support or medical insurance premium payments
