Require creditors to notify consumers 30 days before sending debts to collection or notifying credit bureaus

Created by A.P. on April 09, 2015

Consumers need protection from creditors which fail to notify the consumer of a charge before a damaging item appears on the consumer's credit history. This may be considered a supplement to the FCBA.

To that end, please introduce legislation which requires creditors to notify consumers by telephone, U.S. Mail AND e-mail 30 days before:
- engaging a collection agency (CA) to collect an amount owed, and
- notifying any consumer reporting agency (CRA) (e.g. Equifax, Transunion, Experian) of any collections.

unless the consumer has explicitly opted out of a communication method. The creditor must still contact the consumer by a method from which the consumer has not opted out. If the consumer pays the amount owed, the creditor may not engage a CA or notify a CRA about the charge.
