Currently any veteran filing a disagreement with a decision at the regional level has a right to an appeal to the Board of Veterans’ Appeals in DC. Regardless of prior decisions concerning your disease or condition, the burden is placed upon the veteran to reprove his case. Not only reprove but the veteran CANNOT use prior decisions to make his or her case. In the case of a deadly disease, the veteran better outlive the process because the BVA makes it especially hard for the survivor to prevail before it.
