The FAA Modernization and Reform Act of 2012 contains a loophole enabling the FAA to evade its legal obligation to conduct environmental studies and full disclosure. This loophole, the Categorical Exclusion, allows citizens only 60 days to challenge the FAA’s actions.There is no way for a citizen who wishes to object find out when an action has been approved by the FAA that takes advantage of the Categorical Exclusion loophole. The FAA is not required to publish anywhere the specific date their act. As of September 18th, the FAA changed the fight path for Sky Harbor in Phoenix with no notice to residents.
