It creates a substantial appearance of impropriety and undermines the Freedom of Information Act when federal government employees (or employees at quasi-independent government agencies) transact government business on a personal e-mail account. The President and Congress should criminalize such activities to dissuade the practice. Accordingly, I would propose that the President and Congress enact the following felony punishable by fines and/or prison: a government employee knowingly using a non-governmental or personal e-mail account to perform any government-related duties.
