Brutal, cruel, and inhumane treatment of prisoners should be considered a violation of the Constitutional ban on unusual punishment. Registration and ensuing Federal inspection of non-Federal penal institutions and organizations will assure that prisoners are treated properly within the Constitution. Facilities not complying with the Constitution or associated Federal guidelines should be compelled to change their practices or close. Prisoners who have endured unconstitutional practices should be able to appeal to Federal courts for reduction of sentences.
