By sending a cease and desist letter, corporations are accusing the recipients of copyright or trademark infringement, which is considered a crime. If companies want to take this measure, they should have to prove that the recipients are not exercising their right of fair use. The only way to ensure that this happens is to require a warrant from a judge and/or consent from the U.S. Patent and Trademark Office.
