The Constitution of the United States defines the act of treason as "levying War against them, or in adhering to their Enemies, giving them Aid and Comfort."
The President of the United States, advised that an ambassador, citizens and sovereign properties of the United States were under siege by radical Islamic terrorists at Benghazi, Libya, and that a military force of the United States was fully prepared and ready for immediate dispatch to defend the citizens and property of the United States, refused to act in defense of those citizens and the Nation's territory, ordered military forces to stand down, and relieved military commanders from duty when it appeared that order would be disobeyed.
In so doing, the President did give aid and comfort to enemies of the United States.
