The Federal government must respect the privacy of email and other data citizens store on the Internet. We ask President Obama to issue an executive order clarifying that all Federal agencies with investigative authority must obtain a search warrant from a judge in order to compel holders of private data on the Internet to turn it over to an investigator.
Citizens store private data on the Internet whenever they send email, post on a social website, upload files to the cloud, etc. Today, Federal agencies have various policies for demanding that entities holding such data hand it over, with some agencies requiring only a subpoena. Our Fourth Amendment protection against unreasonable searches and seizures clearly mandates a judicial search warrant in all such cases. Please make it so!
