In 2012, the IRS’ revised Ruling 2012-18 put an end to restaurants adding a gratuity to the bill. The practice of adding a gratuity has been employed by restaurants for years with diners in groups of 6 or more and starting in January 2014, the law goes into effect.

Our position is that for many millions of American restaurant service workers - wait staff, bus persons, bartenders, etc., whose hourly wages are as low as $2.13/hour in most states will have their income significantly reduced when the law is enacted.

The time and effort involved in handling a dinner party of 6 or more justifies the automatic gratuity. The possibility of getting no tip for hard work is now a reality.
