Under the Indian Child Welfare Act(ICWA), the parental rights of anyone that is non-Native are easily taken away and handled over to the opposing party(Native American parent). Instead of resolving the issues in the state judicial system; the tribal courts on the reservations will take over jurisdiction. Their main goal is to keep and continue to instill their culture on the reservation. What about the culture of anyone who is not Native American? What about the rights of a father or mother who don't have this federal jurisdiction in their corner? This law is biased and displays reverse discrimination. Every parent deserves a fair trial in court and an equal opportunity at being the best mother or father that they can be.Cultural preservation should not separate a child from their parents.
