Currently insurance companies have a clause called the non response clause which allows an insurance company to deny a claim if the policy holder does not respond to the claim. This clause puts the public's health and property at risk because the public can suffer loss just because the offending party does not give a statement. Each claim is investigated whether or not a statement is made. That being said, that clause is clearly a way for the insurance company to get out of paying for a claim they would other wise would be liable to pay. I propose making changes to the law stating that failure to make a statement is admission to liability and would result in a payout if the adjuster's investigation supports the claim made by the offended party.
