The Federal TBI Program of 1996 (PL 104-166), 2000 ammendments (PL 106-310), and the TBI Act of 2008 (PL 110-206) authorized Congress to better provide for the large numbers of individuals and families struggling to access appropriate special education classification/services in schools and community based services for victims of traumatic brain injuries,
(including Senator Gifford and members of our military).The addition of the TBI Act and the special education classification of TBI was extremely important and shed light on the need for services. However, the current federal definition of TBI-traumatic brain injury, clearly omits and overlooks victims (primarily children) of non-traumatic brain inuries sustained in utero or during birth trauma.This is unjust and needs to be rectified.
