Carriers should not be allowed to use hardware or software to 'lock' a phone to their service, even if subsidized and 'under contract'. All phones should be sold unlocked and remain that way.
CDMA phones should be designed both in hardware and software to allow for switching services with nothing more complicated than a wipe and reinstallation of the operating software and selecting a different carrier.
Further, starting on a pre selected date (Jan 1, 2014 has a nice ring to it) all phones sold in the US should be required to contain both the hardware and software to run on both GSM and CDMA networks with unlocked sim cards and the previously detailed software for CDMA systems.
