The United States Supreme Court ruled in 1981 that military retirement could not constitutionally be ruled marital property. In response, Congress passed the Uniformed Services Former Spouse Protection Act. This was initially done to provide support for those spouses that gave up their own careers to support the service member. With the advancement of women's rights, access to online college courses, and the transferability of career locations, this law is now extremely outdated.
Service members are deploying to contingency operations at an alarming rate and these separations are breaking up these military families.
