In 2003, the Supreme Court, in Lawrence v. Texas, held that homosexuals' right to liberty under the Due Process Clause gave them a right to engage in consensual sexual activity in the home without government intervention. Nevertheless, Louisiana continued to apply its "Crimes Against Nature" statute, criminalizing two persons of the same sex engaging in consensual sexual activity. Consequently, this past Summer, a dozen men were arrested by police enforcing a law that had been deemed unconstitutional a decade earlier.
Hoping to correct this, a bill was introduced this year to repeal the null portions of LSA-RS 14:89. Sadly, on April 15, 2014, the LA legislature failed to pass HB12 by a vote 27-66. The Obama administration should rebuke this discriminatory behavior by a state legislature.
