10 USC § 1414 (b)(2) prevents military veterans retired for physical disabilities with less than 20 years of service from receiving concurrent pay (both military retirement pay and disability compensation).
As of 2004, any military retiree with at least 50% disability and at least 20 years of service is allowed to receive concurrent pay.
I served 11 years on active duty before being medically retired in 2008 for service-connected disabilities (I'm rated at 80% with an appeal still pending 5 years later). My reenlistment in 2007 would have taken me to 16 years, and I planned to finish my career, but wasn't allowed to due to service-connected disabilities.
I, and many other veterans, receive NO retirement pay since we couldn't serve 20 years. Why isn't this disability discrimination?
