Standardize SSDI claim, appeal, and ALJ review of claims as well as shift the burden of proof to SSDI to revoke benefits

Created by J.R. on February 24, 2013

This petition means to shift the burden of proof from the claimant to Social Secuity Disability Insurance in considering, appealing, continuing, and/or decertifying SSDI benefits approved by an ALJ.

A case can take 2-3 years to reach an ALJ to appeal lower SSDI decisions. This petition seeks to standardize the initial SSDI review period to 1 year. The appeal and ALJ process to 2 years. The recertification period standized to every 3 years for all disability conditons vs the current staggered 3, 7, or 11 years which arbitrary makes severity distinctions among contions.

If the government can dictate compliance periods for IRS filings, Driver's Licenses, and professional certifications, it should be accountable to the public for timely responses and that citizens are assumed innocent.
