[Civil] forfeitures have evolved into big business for police agencies across the country, from the federal Drug Enforcement Administration to small-town sheriff’s offices. The available data makes clear that billions of dollars in cash, real estate and other assets are confiscated nationwide every year. Forfeiture creates victims [often minorities], accused of no crime, without the financial resources or legal know-how to protect their assets.
These seizures should occur through criminal statutes, coming into play only after the accused has had his day in court. Proceeds should go into a general fund, not directly to law enforcement to promote transparency.
