After seeking consumer advocate assistance from CBS News, we learned it is legal for banks to embezzle funds from customer accounts by manufacturing overdraft fees by manipulating the posting of debits out of the order by which they occur resulting in fraudulent overdraft fees that would not occur if debits were posted honestly in the order by which they occur. This is legal so long as banks disclose this behavior to the online banking customer. Disclosure, if it exists at all, is in fine print and obscure. (e.g. last fine print entry on back of bookmark size enclosure among many larger statement enclosures included with statements only quarterly). Software changes to online banking programs accomplish this automatically. Banks also now add pending pymts $'s to balance duping overspending.
