No company or employer will receive approval for a work visa for a non-citizen of the United States of America until posting the job opening nationally for a minimum of six months. The employer requesting a visa for a non-citizen must provide documentation that the job opening is posted in a manner that job seekers could have access to the posting. The employer/ company may not require a lower skill set for a visa and all applicants for the position must have proficiency above the qualified US applicant in the exact skill set required of the US applicants. Coverage of relocation expenses must be offered for a US citizen or they may not be offered for a non-citizen. Violation fines will be 3 years salary and benefit costs paid to the most qualified US citizen who was denied the position.
