The state of Mississippi has just denied the right of a death row inmate, Willie Manning, to have DNA evidence from his case tested.
In a 5-to-4 decision in April, the Mississippi Supreme Court ruled that there was "conclusive, overwhelming evidence of guilty" and that DNA tests would not "preclude his participation in the crimes," even though dissenting Justice James W. Kitchens argued that "whatever potential harm the denial seeks to avert is surely outweighed by the benefits of ensuring justice by the scientific analysis of all the trace evidence."
I believe that most reasonable and reasoning persons would agree with Judge Kitchens. Stop the murder of possibly innocent people by making DNA testing of evidence mandatory before a death sentence may be carried out.
