Equal protection under the law! The 5th Amendment prohibits the government from depriving individuals of “life, liberty, or property” without due process of law & implicitly guarantees each person equal protection under the law. The 14th Amendment prohibits states from violating an individual's rights of due process & equal protection. Smokers are looked upon as second class citizens by being forced to be separate from others in businesses, schools & public events. We are also taxed higher than any other consumer product in the nation. The discriminatory actions, regulations & practices directed at smokers are illegal, unconstitutional & needs to stop. Tobacco is a legal product sold to consumers. If it’s legal to sell, it should be legal to use freely in the manner it was intended.
