I can concede that there is just cause to subpoena telephone records for suspected criminals, but confiscating phone records of multiple millions of Americans directly contradicts a persons right to privacy. In the past probable cause was shown to obtain a warrant for such phone records, and a judge with some sort of public oversight was in charge of handling such warrants to invade the public trust. Having neither just cause, nor public oversight for seizing non-public records such as phone and telecommunication records should not be permitted. Even the sighted FISA was limited to persons who posed a relevant threat to things such as 'national security', and there is no relevance to relate this justification to multiple millions of Americans. Where is the 'transparency in government'?
