Recently, DOL started auditing PERM applications on a purely random basis apparently, and then denies many such applications if DOL deems it unsatisfactory. Decision on an audited PERM application(approval/denial) usually takes 7-8 months or more. So, an employer and the applicant/beneficiary has to wait for an year or more to get the final decision on PERM application if audited, which is staggering in an already arduous employment based green card process. Since most audits are randomly picked, if there are two applicants for the same position and employer, one may get his/her application certified in 4 months, but the other applicant may have to wait for 1 year to get certified or denied, because of bad luck. This is unfair and a severe deterrent for many well qualified applicants.
