The constitution mandates that the Senate provide Advice and Consent on presidential nominations. On a massive and unprecedented scale, the Senate has failed to provide this Advice and Consent. By abusing its own rules in order to delay voting on presidential appointments, the Senate has unconstitutionally interfered with the executive branch's responsibility to carry out the laws of the land. These delays are currently at a crisis level, with 90 federal judgeships and 68 executive-level positions remaining vacant. Since "Advice and Consent" was not intended to be a tool for impeding the day-to-day running of the federal government, the White House should petition the courts to rule that the Senate must vote on nominations in a timely manner or be judged to have consented by default.
