Sue the Senate Republicans for failing to fulfill their Supreme Court Justice Article 2 Section 2 Constitutional duties

Created by K.H. on February 19, 2016

Senate Republicans are obstructing the constitutional mandated process to fill the recent vacancy to the Supreme Court by threatening to: withhold/obstruct any Judiciary Committee hearing for any nominee offered up, withhold/obstruct any full Senate vote and/or delay the process until the President stops offering up nominees or such time that his term ends. The language of the Article 2 Section 2 of the Constitution describes both the President’s and the Senates’ duties as mandatory: “The President…shall nominate, and by and with the Advice and Consent of the Senate, shall appoint…Judges of the Supreme Court.” The Senate Republicans should be sued for violating their oaths of office by abandoning their constitutional duty as well as preventing the President from fulfilling his.
