The Nevan Act is a drafted bill proposing the amendment of the Code of Federal Regulations 32 C.F.R. 516.10d
Under this law, active duty soldiers and sailors have the right to deny service of process for State court proceedings. As such, the law deprives custodial parents their rights to due process in civil litigation regarding child support, custody, and/or paternity for soldiers outside State jurisdiction.
The Nevan Act would require service of process by commanders and supervisors in exclusive and concurrent Federal jurisdictions and mandate involuntary acceptance of service by individuals in the United States Armed Forces in civil litigation within State jurisdiction regarding paternity, custody, and/or child support.
