The culprit behind the tragic Gold King mine spill that effected the San Juan watershed is long entrenched in the nations legislature. The 1872 Mining Law is an archaic piece of legislation that allows for mining claims to trump all other uses and rights of public and federal lands. This mining law was designed to encourage the settlement of the west through obscenely cheap prices along with the absence of royalties.
