In 2016, the gridlock between President Obama and the Republican led Senate exposed two ambiguous aspects of the Constitution: First, that there is no defined number of Justices in the Supreme Court and, second, that the Senate may not consider or consent to a nomination made by the President.

The effect of this ambiguity may lead to a shutdown of the Judicial branch and remove a critical check and balance of power on the other two branches of government. To prevent this from happening we must amend the Constitution to preserve the Judicial branch and protect it from gridlock that paralyzes the Executive and Legislative branches of government.

This proposed amendment is non-partisan. Over time, any party may benefit from it.
