Retired military personnel drawing pay are subject to the U.C.M.J. This person is allegedly a U.S. Army retiree drawing retired pay. She allegedly violated 18 U.S. Code § 700-Desecration of the flag of the United States (a)(1) "Whoever knowingly mutilates, defaces, physically defiles, burns, maintains on the floor or ground, or tramples upon any flag of the United States shall be fined under this title or imprisoned for not more than one year, or both." Furthermore she can potentially be considered in violation of U.C.M.J. Punitive Articles 92, 94, and 134. This petition addresses the request of the people to direct the Department of Defense and U.S. Army to investigate this matter determining if U.C.M.J charges should be levied against this individual and rescinding of retiree benefits.
