No rule of criminal procedure is older than the one forbidding the government to try defendants twice for the same offense. It was considered so fundamental to due process that it appears in the Bill of Rights is not surprising.
The Fifth Amendment language seems clear—“nor shall any person be subject for the same offense be put in jeopardy of life or limb”
We are a nation of laws, and when our leaders abuse those laws for personal gain, it weakens our nation. Use the George Zimmerman trail as an example, and no not allow a person to be subject for the same offense. That is not the purpose of the Civil Rights laws, unless you review each and every case in the country that is similar in nature and treat each case equally.
The only hate crime occurring now is against George Zimmerman.
