The Federal Courts have ruled that an elected official (executive branch) within a states government; is not held accountable to the laws of that state when he refuses or neglected to qualify his office; as demanded by the People of that state.
In Colorado, an elected district attorney, Mr. David J. Thomas; refused to qualify his office for his term(s) of office via the Colorado Constitution and the States laws; thus rendering his Office vacant by constitutional law. He further refused to adhere to Colorado Statutes in regards to his Office and illegally prosecuted U.S. Citizens in Colorado
However, when challenged in the Colorado Courts ruled that legislative precedents apply to the executive office of district attorney and cited federal case law that supports these violations.
