Use a recess appointment if necessary to fill the vacancy on the U.S. Supreme Court.

In 1956, President Eisenhower installed Justice William J. Brennan to the Supreme Court in a recess appointment shortly before the 1956 Presidential election. Justice Brennan served on the New Jersey Supreme Court and therefore had not been confirmed by the Senate to sit on the federal bench at the time of his appointment. He was confirmed in 1957 with only WI Senator Joseph McCarthy in opposition. Justice Brennan served with distinction until 1990, making him the 7th longest serving Justice in history. Mr. President, you have an obligation under Article II of the Constitution to fill the vacancy created by the death of Justice Scalia and we,the undersigned, urge you to fulfill that obligation even it is with strong objection from your political adversaries
