In light of the recent passing of SCOTUS Justice Scalia we issue our condolences to his family. However, the issue of filling the vacancy created by his passing is larger than any one political party. It is imperative for continuity of government that the SCOTUS has a full complement of Justices. Given an implacable opposition from the Republican controlled Senate in which Senate Majority Leader Mitch McConnell has vowed not to take up the confirmation process for individual the President will nominate to fill the vacancy then We ask that the President utilize his constitutional authority under Article II, Section 2 of the Constitution states that “The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate.” The Senate is in Recess.
