The ITC issued an import ban on the Apple iPhone 4 and iPad 2 based on infringement of Samsung's Standard Essential Patents (SEPs). Regardless of who is at fault here, Samsung for not granting fair and reasonable terms to license its SEPs, or Apple for not licensing them at the terms offered, the ITC should not be able to ban a product that infringes such a minor and essential patent. This enables companies to hold others hostage over SEPs that are supposed to be standards that all companies may use. The President should veto this ban and call on congress to reform the patent system.
