I am arguing that people should be allowed to use their 401(k)s to start businesses without fees to the IRS especially those new businesses that will be hiring additional employees within the first two years of operation. When I went to open my company, I researched how to get around the 401(k) fees to the IRS and found several lawyers offering to draw the paperwork up to help me form a corporation which would form the 401(k) and invest directly in itself. They knew how much money I was withdrawing from my 401(k), so they could easily calculate their fee to be almost the same amount to set up the Corporation as the IRS fees would be. Making this change could incentivize a lot more people to start small, part-time or full time jobs for themselves and others which could ultimately raisetax$s
