Not only did Congress, by choosing not to act, abdicate its right to participate in the process of choosing, but the President has a moral duty to leave the country in as safe a state as he is capable of, so appointing the missing Supreme Court Justice he not only reengages the power of an odd-numbered court, but also cements his legacy while preserving the rights of millions of Americans who would see among other things extreme religion dismember the progress made the last 50 yrs.
