We The People seek to have tipped industry positions recognized as 1099 subcontractor positions of employment

The goal of this petition is to recognize any W2'd person as a 1099 sub-contractor for purposes of allowing this current\future associate the right to operate their current skill as a "B2B Service". In this day and age business operators will hire an associate for minimum wage, offer less than the required amount of hours to obtain insurance benefits, and even opt to have the associate pay a tip-out to support positions to supplement the cost of having said support on the floor. The growth of the staffing agency industries support the need for this change in status as business operators seek to partner with staffing agencies to fly under the radar of the law with Obamacare. This adds significant disadvantage for the tipped worker as operators are outsourcing todays work legally.
