The American people deserve to have a Supreme Court with nine justices. The Senate has failed its Constitutional duties by preventing a vote on Merrick Garland's nomination to the Court.
Therefore, Vice President Joe Biden should recognize Senator Dick Durbin as the then-majority leader of the 66 remaining senators at 12:00pm on January 3. The Vice President can take this very action by following the procedures outlined here:
