The 2nd Amendment wasn't written so we could hunt animals. It was written so that the militia which is comprised of the people would have the right to individually keep and bear military rifles and pistols. That's the whole point of the amendment. That means that an "Assault" weapons ban would be a complete violation of the Constitution. A supposed tyrannical government would have the latest and greatest arms, and so should the people's militia. The 2nd Amendment still covers modern guns for the same reason the 1st Amendment covers the Internet.

Also it is imperative that you understand that factory magazine capacity is standard capacity not extended capacity. Reducing the standard factory capacity would limit ones ability to defend themselves during an attack.
