Why Obama admin has not sued the senate for abdication of its responsibility to consider Marick Garland for SCOTUS

By not holding vote for confirmation of the presidents nominee for Supreme Court Justice, Marick Garland, the senate has abdicated its responsibility to We the People and is in violation of the constitution, Article II. Given this violation, the Obama administration has both standing to sue the senate and should do so before the end of its term.
